Bankruptcy Law

Weiner & Lange, P.C. has over thirty years experience in their bankruptcy and creditors' rights department. The firm’s initial focus in 1994 revolved around commercial and bankruptcy law. The firm represents debtors, creditors (unsecured and secured), and Trustees in Bankruptcy Courts and State and Federal Courts. The firm also does work-outs and out-of-court settlements.

On all matters, we attempt to analyze the facts and circumstances presented and determine what is the best course of action for the client, both in and out of the Bankruptcy Court. The firm has extensive experience in defending and prosecuting preference actions, fraudulent conveyances, lien discharges, and non-dischargeability actions.

The firm represents parties in Chapter 7, Chapter 11, and Chapter 13 proceedings. For a brief overview of each of these Chapters, please click on the attached article link for more detailed information: Bankruptcy: An Overview. The firm recognizes the financial difficulties which bankruptcy puts on both the debtor and the creditors and we work in an effort to resolve the issue as soon as possible.

It is our goal to be efficient with our time and therefore economical for our clients. We further recognize that sometimes the difficulties involved require the time necessary to reach the goal we are seeking.

In most cases, the filing of a bankruptcy petition will grant a debtor a stay from actions against both the debtor and his property. The goal for most debtors in a bankruptcy proceeding is to get relief from the actions of creditors and obtain a discharge of their legal responsibility to pay the creditor. Consultation with counsel is essential in determining which Bankruptcy Chapter is appropriate.
